Welcome to GTA Paint. These Terms of Service ("Terms") govern your use of our website, services, and any painting work performed by GTA Paint ("we," "our," or "us").

By accessing our website, requesting our services, or hiring GTA Paint for any painting work, you agree to be bound by these Terms. If you do not agree to all of these Terms, please do not use our website or services.

These terms apply to all our services including residential painting and commercial painting projects across the Greater Toronto Area.

Acceptance of Terms

These Terms constitute a legally binding agreement between you and GTA Paint. By using our website or services, you:

Confirm that you are at least 18 years old or have parental consent
Have the legal capacity to enter into this agreement
Agree to comply with all applicable laws and regulations
Accept responsibility for all activities under your account

If you are using our services on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these Terms.

Our Services

GTA Paint provides professional painting services including but not limited to:

Residential Painting: Interior and exterior painting for homes and apartments
Commercial Painting: Painting services for offices, retail spaces, and commercial buildings
Specialty Services: Cabinet painting, wallpaper removal, drywall repair, and color consulting
Consultations: Free quotes, color recommendations, and project planning

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of our services. Visit our painting services page for detailed information about our offerings.

Your Responsibilities

As a customer of GTA Paint, you agree to:

Provide accurate and complete information when requesting quotes or services
Prepare the property as agreed upon before work begins
Ensure safe access to work areas during service delivery
Make timely payments according to agreed payment terms
Communicate any concerns or changes promptly
Respect our team members and their property
Remove personal belongings from work areas or protect them appropriately

Failure to meet these responsibilities may result in additional charges, delays, or cancellation of services.

Payment Terms

Pricing and Quotes

All quotes provided by GTA Paint are valid for 30 days from the date of issuance unless otherwise specified. Prices are based on agreed-upon scope of work and are subject to change if the scope changes.

Deposit and Payment Schedule

A deposit of 30-50% is required to schedule work
Progress payments may be required for larger projects
Final payment is due upon completion and satisfaction
Payment methods accepted: Cash, E-transfer, Credit Card, and Cheque

Late Payments

Late payments may incur interest charges of 1.5% per month (18% per annum) on the outstanding balance. GTA Paint reserves the right to suspend work if payments are not made according to agreed terms.

Cancellation Policy

By Customer

7+ days before start: Full refund of deposit
3-6 days before start: 50% refund of deposit
Less than 3 days before start: No refund of deposit
After work begins: Customer is responsible for all work completed and materials purchased

By GTA Paint

We may cancel services due to unforeseen circumstances including but not limited to: extreme weather, safety concerns, property access issues, or changes in material availability. In such cases, we will provide full refund of any deposits paid and reasonable notice of cancellation.

Our Warranties

Workmanship Warranty

GTA Paint provides a 2-year workmanship warranty on all residential and commercial painting services. This warranty covers:

Peeling, blistering, or flaking paint due to improper application
Adhesion failures
Application defects

This warranty does not cover:

Normal wear and tear
Damage from water leaks, structural issues, or environmental factors
Surfaces not properly prepared by the customer
Paint failures due to underlying surface conditions

Material Warranty

Manufacturer warranties apply to all paints and materials we use. These warranties typically range from 10-25 years depending on the product. We will provide warranty documentation for all materials used in your project.

Limitation of Liability

To the fullest extent permitted by law, GTA Paint shall not be liable for:

Indirect, incidental, special, or consequential damages
Loss of profits, revenue, data, or business opportunities
Damage to personal property not properly protected by customer
Delays caused by factors beyond our control (weather, material shortages, etc.)
Claims exceeding the total amount paid for services

Our total liability to you for any claims relating to our services shall not exceed the total amount you paid for those services.

Indemnification

You agree to indemnify, defend, and hold harmless GTA Paint, its employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of our services
Your violation of these Terms
Your violation of any third-party rights
Any hazardous conditions present on your property
Any act or omission by you, your family members, or pets

Property and Safety

Property Access

You agree to provide GTA Paint with safe, unobstructed access to work areas during scheduled work hours (typically 7:00 AM to 7:00 PM, Monday through Saturday).

Pets and Children

Please ensure pets and children are kept away from work areas for their safety and to prevent interference with work. We are not responsible for any accidents involving pets or children in work areas.

Valuables and Belongings

Please remove or protect valuable items, artwork, and furniture from work areas. While we take reasonable care, GTA Paint is not responsible for damage to personal property that was not removed or protected as requested.

Intellectual Property

All content on GTA Paint website, including text, graphics, logos, images, and software, is the property of GTA Paint or its content suppliers and is protected by copyright laws.

You may not use, reproduce, distribute, or create derivative works of any content from our website without prior written consent from GTA Paint, except as permitted by law.

Modifications to These Terms
